Step 1 – Cheque Dishonour

When a cheque is presented to the bank and returned unpaid due to reasons like insufficient funds, account closed, or payment stopped, the bank issues a cheque return memo.

Step 2 – Sending Legal Notice

Within 30 days of receiving the bank return memo, a legal notice must be sent to the cheque issuer demanding payment of the cheque amount.

Step 3 – Waiting Period for Payment

After receiving the legal notice, the cheque issuer is given 15 days to make the payment. If the payment is made during this time, the matter can be resolved without court action.

Step 4 – Filing the Case in Court

If the payment is not made within 15 days, a complaint can be filed in the Magistrate Court under Section 138 NI Act within the prescribed time limit.

Step 5 – Court Proceedings

Once the case is filed, the court will issue summons to the accused and begin the legal proceedings. Our lawyers represent you and handle all legal documentation and court appearances.

Step 6 – Judgment or Settlement
